These terms cover your use of the Flourish Academy website at flourishacademy.learnworlds.com (the "Site"). The Site is run by Flourish Academy, LLC ("Flourish Academy," "we," "us"), a Flourish Medical + Wellness company based in Savage, Minnesota. By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

1. Who the Site is for. The Site is for licensed medical providers and others interested in our provider training. You must be at least 18 to create an account.

2. Website terms vs. Program Terms. These terms cover the website only. If you are accepted into the Flourish Academy program, your enrollment is governed by the separate Flourish Academy Program Terms & Conditions, which you will receive and sign at that time. If the two ever conflict, the Program Terms control.

3. Educational information only. Content on the Site is for general education for licensed professionals. It is not medical advice and does not create a provider-patient relationship with anyone. It is not a substitute for your own clinical judgment or your scope-of-practice and licensing rules.

4. No guarantees. We do not guarantee any particular clinical, business or financial result from using the Site or our program. Any examples or descriptions of results are illustrative and are not promises.

5. Your account. Keep your login private and your information accurate. You are responsible for activity under your account. Tell us right away if you think your account has been misused.

6. Applications. Submitting an application does not guarantee acceptance. We review every application and may accept or decline at our discretion.

7. Payments. Program fees and billing terms are set out in the Program Terms and at checkout. All sales are final and fees are non-refundable. By completing a purchase, you agree to the Flourish Academy Enrollment Agreement (Program Terms) for the program you purchase. Payments are processed by our third-party payment processor; we do not store full card numbers.

8. Our content. The Site's content, including the Flourish Method name, course materials, videos, text, graphics and logos, belongs to Flourish Academy or its licensors. You may view it for your own personal, non-commercial use. You may not copy, share, resell, record or create derivative works from it without our written permission.

9. Acceptable use. Please do not:

• Share your login or let others use your account
• Post or upload patient-identifying or other protected health information
• Upload anything unlawful, harmful, misleading or that infringes someone else's rights
• Try to hack, scrape, disrupt or reverse-engineer the Site

10. Third-party services and links. The Site runs on the LearnWorlds platform and may link to or use other third-party services. We are not responsible for their content or practices.

11. Disclaimer. The Site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

12. Limit of liability. To the fullest extent the law allows, Flourish Academy is not liable for indirect, incidental, special or consequential damages from your use of the Site. Our total liability for any claim related to the Site is limited to the amount you paid us in the 12 months before the claim.

13. Indemnity. You agree to cover our losses and reasonable legal costs if a claim arises from your misuse of the Site or your breach of these terms.

14. Ending access. We may suspend or end your access if you break these terms or misuse the Site.

15. Governing law. These terms are governed by Minnesota law. Any dispute will be handled in the state or federal courts located in Hennepin County, Minnesota.

16. Changes. We may update these terms. We will post the new version here with a new "Last updated" date. Continuing to use the Site means you accept the changes.
